Terms & Conditions of the Upstaff.com service
Registration on the Upstaff.com website automatically means that you accept this Agreement and accept the Terms & Conditions of the Upstaff.com service. The agreement comes into force at the moment you send registration data. If you have any disagreements with these rules or part of these rules, then you can at any time refuse to use the site Upstaff.com (hereinafter referred to as the Platform).
1.TERMS AND DEFINITIONS
Platform is a set of software and hardware that are combined under the domain Upstaff.com, and are provided communication between the Platform Participants.
Administration is the owner of the Platform
The Platform Participant is a natural or legal person registered on the Platform who agrees to the terms of this Agreement.
Account – login and password required to gain access to the Platform’s capabilities and the personal page of the Platform Participant.
2.GENERAL PROVISIONS
2.1.By agreeing to these rules, the Platform Participant accepts all clauses of these Rules and undertakes to follow them or refuse to use the Platform.
2.2.These Rules, as well as any changes to them, come into force from the moment of their publication on the Platform. Changes to the Rules are made by the Platform at any time, without compulsory notification to the Platform Participants. Each new authorization is automatically considered a fact of agreement with the current version of the Rules.
2.3.The Platform provides the Platform Participant with the service of accessing the Platform’s capabilities without interruptions, unless it is necessary to carry out service work. The administration is not responsible for any delays or failures that occur during the work, as well as for the loss of unsaved non-confidential information by users.
3.RIGHTS AND OBLIGATIONS OF THE PARTIES
3.1.Rights and obligations of the Platform participants
3.1.1.The Platform Participant is responsible for the accuracy of the information in his Account and any information that he publishes on the Platform.
3.1.2.The following are prohibited on the Service:
3.1.2.1.Appeals to violent change or overthrowing the constitutional order or the seizure of state power; appeals for a change in the administrative borders or state border of Ukraine, violation of the procedure established by the Constitution of Ukraine; appeals for pogroms, arson, destruction of property, seizure of buildings or structures, forced evictions of citizens; appeals for aggression or for the outbreak of military conflict.
3.1.2.2.Offensive behavior and expressions, including those containing elements of insults on the basis of racial, ethnic or religious affiliation, as well as statements that are chauvinistic in nature. Such behavior is prohibited both in relation to the Administration, and in relation to other Platform Participants.
3.1.2.3.Placing orders and advertising by the Platform Participants:
goods and services that are contrary to the laws of Ukraine;
goods and services that violate the intellectual property rights of any third party;
malicious software or any programs that could harm any third parties, the Platform Participants and the Administration.
3.1.2.4.Any actions that are prohibited by the legislation of Ukraine.
3.1.3.The Platform Participants agree that the Administration has access to all Platform data, including personal messages from the Platform Participants.
3.1.4.All Platform Participants are entitled to register no more than one Account. Registering more Accounts is prohibited. The transfer of your account settings to third parties is also prohibited. The sale and purchase of Accounts is also prohibited.
3.1.5.All Platform Participants agree to fulfill the obligations specified in personal messages to other Platform Participants.
3.2.Rights and responsibilities of the Administration
3.2.1.The Administration determines the rules for using the Platform and has the right to demand the implementation of these Rules from the Platform Participants.
3.2.2.The Administration has the right to make changes to these Rules and not to notify the Platform Participants specifically about this.
3.2.3.The Administration has the right to send information messages to the Platform Participants that relate to the terms of use of the Platform. Messages can be sent to the email address provided during registration. Registration means automatically accepting informational messages only.
3.2.4.The Administration is not responsible for the accuracy of the data published by the Platform Participants and the correctness of their communication.
3.2.5.The Administration can deprive the participants at the platform right of access to the Platform, if the Participant Platform violates these rules.
3.2.6.The Administration is not responsible for the information, opinions, advice and recommendations that the Platform Participants place in personal messages.The administration has the right to block or delete the Platform Participant’s Account and/or delete any of its content without giving a reason.
3.2.7.The Administration is not responsible for the information, opinions, advice and recommendations that the Platform Participants place in personal messages.
3.2.8.The Administration is not responsible for errors when loading data on the Platform and cannot be held liable for any losses (including lost profits) that have arisen due to such errors.
3.2.9.The Platform participants give unconditional consent to the processing by the Administration of personal data in order to ensure the obligations described in these Rules. Platform participants also agree that the Administration should not receive additional consent for the processing of personal data.
3.2.10.The Administration has the right to block the Account of the Platform Participant in case of a large number of complaints from other Platform Participants.
4.PROCEDURE FOR DISPUTES AND RESPONSIBILITY OF THE PARTIES
4.1.The Platform Administration does not participate in disputes (including in court) between the Platform Participants, including those involving third parties.
4.2.The Platform Administration is not responsible for the quality of work performed by the Platform Participants.
4.3.The Platform Administration is not responsible for any losses (including in the form of lost profits) of the Platform Participants arising in case of use or impossibility of using the Platform.
4.4.The Platform Administration is not responsible for illegal actions of the Platform Participants.
4.5.The Platform Administration is not responsible for the data posted by Platform Participants on the Platform.
4.6.The Platform Participant is responsible for any actions that he performed on the Platform.
4.7.The Platform Participant is responsible for ensuring the security of his Account data.
5.PAYMENT TERM
5.1.The Platform operation is free, except for clearly established tariffs.
5.2.The Platform Administration reserves the right to introduce additional paid services, change the fee for these services, informing the Platform Participants about this.
5.3.If you have violated these Platform Rules, the funds spent on the service, in the process of use of which the violation occurred, are not returned. But if you could not get the service due to the fault of the Administration, the amount corresponding to the price of the service not received will go to your internal account
5.4.Funds paid by the Platform Participant for access to the service can only be used to receive this service and are not refundable.
6.PERSONAL DATA
6.1.All personal data on the Platform is protected by the Privacy Policy.
